1. General
These Membership Terms and Conditions (“Membership Terms”) govern your participation in the eXp New Homes program (“eXp New Homes” or the “Program”) offered by eXp Realty, LLC and its affiliates (collectively, “eXp”). By enrolling in eXp New Homes, you agree to these Membership Terms together with any enrollment materials, policies, or addenda made available to you. If there is a conflict between these Membership Terms and another agreement you have with eXp, the more specific terms applicable to eXp New Homes will control for matters relating to the Program, except as otherwise stated herein.
2. Enrollment in eXp New Homes
- Enrollment conditions. To enroll, you must: (i) hold an active real estate license and affiliation with eXp in good standing where required; (ii) complete any enrollment steps and acknowledgments requested by eXp; and (iii) agree to comply with Program rules, brand guidelines, and applicable law.
- Enrollment in eXp New Homes. Your enrollment becomes effective on the date eXp confirms acceptance in writing or through the enrollment system (the “Effective Date”), unless another date is specified.
- eXp New Homes certification course. You may be required to complete mandatory training or certification as a condition of enrollment or continued participation. eXp may update training requirements from time to time.
- Removal. eXp may suspend or remove you from the Program for non-payment, violation of these Membership Terms, misuse of marks or materials, or conduct that could harm eXp, builders, or consumers, subject to any notice period required by applicable policy or law.
3. Enrollment period
Your initial enrollment period begins on the Effective Date and continues for the term selected at enrollment (the “Initial Enrollment Period”). If you renew, each renewal term (a “Renewed Enrollment Period”) begins when the prior term ends and continues for the renewal period you select. Fees and benefits apply only for periods in which you are enrolled and in good standing.
4. Membership; benefits
- Membership types; benefits. Program benefits depend on your membership level (for example, Premium Membership or Brand Membership). Canada: https://join.expnewhomes.com/plan-can. eXp may modify benefits with reasonable notice where permitted.
- Upgrades/downgrades. To change your membership level, follow the instructions provided in the Program portal or contact eXp New Homes support at the email address provided in your enrollment materials. Changes may take effect at the start of the next billing cycle unless otherwise stated.
5. Enrollment fees; marketing studio fees
- Enrollment fees. Enrollment and membership fees are non-refundable except where required by law or expressly stated in writing. You may choose monthly or annual billing where offered; annual prepayment may be discounted as shown at enrollment.
- Marketing studio fees. Certain creative or project-based services may incur separate fees, quoted per project or package. You authorize charges for services you approve in writing or through the ordering workflow.
- Payment methods. You are responsible for keeping payment information current. Failed payments may result in suspension of Program access until resolved.
6. eXp New Homes trade name and logo
eXp New Homes names, logos, and related marks are owned by eXp or its licensors. You may use approved assets only in accordance with brand guidelines, builder requirements, and applicable law. You may not alter marks, imply endorsement where none exists, or use marks after your enrollment ends except as permitted for wind-down of materials as directed by eXp.
7. Privacy policy; receipt of promotional information
eXp processes personal information as described in the eXp World Holdings privacy policy: https://expworldholdings.com/privacy-policy/. You may receive operational and promotional communications relating to the Program; you may opt out of marketing messages where applicable without affecting core service notices.
8. Additional terms
These Membership Terms are a binding addendum to your Independent Contractor Agreement or other written agreement with eXp (“ICA”), where applicable. In the event of conflict, the ICA governs general brokerage relationship matters; these Membership Terms govern the Program specifically. eXp may update these Membership Terms; continued participation after notice constitutes acceptance unless you discontinue enrollment as provided.
